Terms of Service for Keycap

Please read these Terms of Service ("Terms") before using Keycap ("the App"), operated by Lucky Ali Khan ("we," "our," or "us").
By downloading, installing, or using Keycap, you agree to these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
By using Keycap you confirm that you are at least 13 years of age, or the minimum age required in your jurisdiction, whichever is greater. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use Keycap on Apple-branded devices that you own or control, subject to these Terms and to the Apple Media Services Terms and Conditions.
This license does not allow you to:
- Copy, modify, or distribute the App
- Reverse-engineer, decompile, or disassemble the App, except to the extent that applicable law expressly permits it despite this limitation
- Rent, lease, lend, sell, or sublicense the App
- Use the App for any unlawful purpose
- Remove or alter any proprietary notices in the App
3. No Accounts
Keycap has no accounts, no sign-in, and no server component. There are no credentials for you to protect and no account for us to suspend. Your use of the App is entirely local to your Mac.
4. Your Typing and Your Practice Subjects
You retain everything you type. Keycap does not transmit it, and does not retain your keystrokes after a run ends — see the Privacy Policy.
When you name a subject for the App to write practice prose about, that subject is passed to the on-device Apple Intelligence model on your Mac. You agree not to use that feature to attempt to generate content that is unlawful in your jurisdiction. Apple's model applies its own safety constraints and may decline a subject; Keycap reports that refusal and asks for another.
Because the generated prose is written by a language model, it may be inaccurate, odd, or uninteresting. It is typing practice material. Do not rely on it as a source of fact.
5. Intellectual Property
Keycap — its design, code, features, and name — is owned by Lucky Ali Khan and protected by copyright and other intellectual property laws.
Keycap incorporates third-party material under licence, including a word-frequency corpus under
CC BY 3.0 and keypress recordings under the MIT and Pixabay Content licences. These are credited in
the App under Settings, and in the NOTICE.md file accompanying the source. Those components remain
the property of their respective authors and are used under the terms of their licences.
6. Price and Purchases
Any purchase of Keycap is made through the App Store and processed by Apple. Prices are shown in your local currency at the point of purchase.
Refunds are handled by Apple, not by us. Request one at reportaproblem.apple.com. We are unable to process refunds directly.
Keycap contains no subscriptions, no in-app purchases, and no advertising. If that ever changes, these Terms will be updated before the change ships.
7. Termination
This agreement remains in effect until terminated.
You may terminate it at any time by deleting the App from your devices. Because there is no account and no server, that is all that is required — see the Privacy Policy for how to remove the App's stored data as well.
We may terminate the licence granted in Section 2 if you materially breach these Terms. Provisions that by their nature should survive termination — intellectual property, disclaimers, limitation of liability, governing law — survive it.
8. Disclaimer of Warranties
KEYCAP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted or error-free, that defects will be corrected, that it will meet your particular requirements, or that stored practice history will not be lost.
Keycap measures typing speed and accuracy and reports what it measured. It is a practice tool. It is not a medical, diagnostic, ergonomic, or occupational-health device, and nothing it reports should be treated as advice about injury, strain, or fitness to work. If typing causes you pain, stop and consult a qualified professional.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRINCE ALI KHAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF KEYCAP.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. Where that is the case, the above exclusions and limitations apply to you only to the extent permitted, and nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
10. Apple
You acknowledge that these Terms are between you and us, not with Apple, and that Apple is not responsible for Keycap or its content. Apple has no obligation to furnish maintenance or support for Keycap. Apple is not responsible for addressing any claim by you or a third party relating to Keycap, including product liability claims, consumer protection claims, or claims of intellectual property infringement.
Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
11. Governing Law
These Terms are governed by the laws of India, without regard to its conflict of law principles. Any dispute arising from these Terms will be subject to the courts of India.
Nothing in this section deprives you of the protection of the mandatory consumer-protection laws of the country in which you reside.
12. Changes to Terms
We may update these Terms. When we make a material change we will update the "Last Updated" date above, publish the revised Terms at https://getkeycap.app, and note the change in the App's release notes.
Continued use of Keycap after a change is posted constitutes acceptance of the updated Terms.
